www.Creativestores.co.uk is a collaboration of virtual stores for creative individuals all over the world to sell their own creations and products. If you are a creative individual or business person and would like your own virtual store, you have come to the right place. You can make and sell your own handmade products, anything organic, artwork, the list is endless. You can also sell/advertise supplies to other creative people. We also accept people who sell gifts whether they are handmade or not.

www.Creativestores.co.uk allows you to create your own virtual store. There are no setup charges, hidden fees, listing fees or commission. You just pay a monthly fee of £1.00 for up to 5 items, £2.50 for up to 50 items and £5.00 for an unlimited size store (which can be cancelled at anytime), enabling you to upload as many items as you like into your own virtual store. You cannot ask for refund of any payments that have occurred. If you wish to cancel your store you will need to give one months' notice.

Membership Eligibility and Registration

If you just wish to search or browse through the stores, you do not have to register with www.Creativestores.co.uk . If you wish to purchase or sell your products online you will need to register. Registration is free of charge. We reserve the right to refuse registration to anyone at anytime. When you register with www.Creativestores.co.uk you must agree to be bound by the Terms and Conditions.

You may not register with www.Creativestores.co.uk if you are under the age of 16.

You must declare accurate and up to date information about yourself or your business in the course of your registration and shop and profile generation, and to update this information at regular intervals.

You must keep your password private and not disclose it to any third party. You cannot transfer or sell your Store or user name to any other person.

We reserve the right to delete accounts that have not validated the registration process. We also reserve the right to remove/delete any content which we deem to be offensive or sexual in any manor.

Suspended users are not allowed to re-register in a different name and abuse the website in any way.

Breach of Terms & Conditions – Cancellation of Account

We may take the following actions without any notice to you if you breach the Terms & Conditions or legal regulations or if we believe your actions may cause us or our members financial loss or legal liability:-

• Delete and remove items which we deem unacceptable to the site ethos.
• False information is provided or an invalid e-mail or postal address.
• Suspend or terminate your registration.
• The feedback you receive contains repeated negativity.
• You transfer your account to another person or third party.
• If you abuse any services www.Creativestores.co.uk offers.
• Any other reason which is not classed as acceptable behaviour.

Your Store and Selling

Registered members of www.Creativestores.co.uk may create their own personal store. YOUR STORE IS NOT AUTOMATICALLY OPEN WHEN YOU REGISTER. The administrator has to open your store upon our secure server. You will then be sent an e-mail when your store is open and ready for you to list your products. You must list your own products in your own store. Sellers are solely responsible for all products listed in their store and for the compliance with legal regulations. This may include Public Liability Insurance if you so wish to.

Setting up your store is free of charge. There is a monthly advertising fee of £1.00 for up to 5 items, £2.50 for up to 50 items and £5.00 for an unlimited size store, payable by subscription through your PayPal account. We do offer a service of listing your items for you. This is only for store owners who already have items listed either on their own personal website or on another marketplace website.

When opening a store on www.Creativestores.co.uk you choose your own store name (CHOOSE CAREFULLY AS THIS CANNOT BE CHANGED AT A LATER DATE). The store name cannot differ from your User Name. Your store name shall not infringe any third party’s rights to be sexually explicit in any way. If we find this to be the case www.Creativestores.co.uk reserves the right to alter your store name or delete the store.

All information you provide regarding the store should be accurate, true and complete. You will need to update your private information as necessary and always provide up-to-date information.

When you list an item in your store, this represents a binding offer at a set price to other users of www.Creativestores.co.uk . The contract of purchase is formed when a member complies with the conditions specified in the offer and clicks the “Buy” button in the shopping basket. The sale only becomes final when the buyer is taken to PayPal's secure server and proceeds to buy the goods.

If for any reason you cancel your subscription and have orders that have not been fulfiled, we reserve the right for the customer to contact you, by first contacting www.Creativestores.co.uk and we shall, if we feel appropriate, release a method for the customer to contact the seller. This is only when the store has been closed either by the store owner or by www.Creativestores.co.uk due to non-payment of subscription charges.

Your products must be listed in the appropriate categories provided. You must provide a text description of your product, along with graphics/pictures of the said product. You will be responsible for ensuring that you have the right to use all the content, including photographs/graphics for your listing and that www.Creativestores.co.uk has the right to host on our servers. Your item description and graphics/photographs must only refer to the item listed and you may not advertise goods not listed on www.Creativestores.co.uk .

All information relating to payment, postage and delivery time must be true.

If you are a business offering goods and services to consumers, you are obligated by law to give all necessary information regarding consumer protection.

The price listed must be the gross price containing potential VAT and any other charges. Postage and packaging fees are not included in the listed price, unless you have stated FREE POSTAGE, which you must make clear to potential buyers of your products . You are not allowed to charge http://www.creativestores.co.uk/ fees to consumers.

Fees and Billing

Opening a store on www.Creativestores.co.uk is FREE. www.Creativestores.co.uk does not charge for buying a product in any store on www.Creativestores.co.uk .

www.Creativestores.co.uk charges Store Owners a monthly Advertising fee of £1.00, £2.50 or £5.00 depending on what option you choose. Stores registered outside of the UK, please note that I can only take payment for your monthly invoice via PayPal.

We may change the fee at any time giving one months’ notice to all Store Owners.

If your collection fails we can incur an administration charge to recover the costs.

www.Creativestores.co.uk keeps your payment information to automatically invoice and charge the services issued to you.

Buying from www.Creativestores.co.uk

The website is used by store owners to advertise and sell their creations/ products for sale. They can link to any store e.g. ebay, etsy, misi, artfire, dawanda.... or any other means of selling their products.

Basic Terms

While using www.Creativestores.co.uk all Members shall be in accordance with legal regulations. The contents provided by Members on www.Creativestores.co.uk shall not infringe legal regulations or our Terms and Conditions.

Your information and activities must not:

1. Be false, inaccurate or misleading
2. Be menacing, offensive, defamatory or abusive
3. Contain any child or adult pornography, be obscene or indecent
4. Involve counterfeit items or stolen goods
5. Infringe on any third party’s copyright, patent, trade mark or other proprietary right or rights of publicity or privacy
6. Be in breach of any applicable laws or regulations (including, but not limited to, laws governing export control, consumer protection, unfair competition, anti-discrimination or false advertising)
7. Copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for your own information) from www.Creativestores.co.uk without the prior expressed written permission of www.Creativestores.co.uk owner and the appropriate third party
8. Create any liability for www.Creativestores.co.uk or cause us to loose in whole or part, the services of our ISPs or other suppliers
9. Link directly to indirectly to or include descriptions of goods or services that are prohibited under these Terms and Conditions
10. Contain any computer viruses, macro viruses, Trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information
11. Cause www.Creativestores.co.uk to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of www.Creativestores.co.uk is in any way impaired
12. Not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission.

Liability and Warranty

www.Creativestores.co.uk is not liable for contracts formed between members of www.Creativestores.co.uk .

www.Creativestores.co.uk is not liable for information on www.Creativestores.co.uk provided by its members. We claim no intellectual property rights over the material provided by members of www.Creativestores.co.uk .

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of a breach of these Terms and Conditions or your violation of any law or the rights of a third party.

In the event that you have any right, claim or action against any other member arising from that member’s use of the site, you agree to pursue such right, claim or actions independently of and without recourse to us, and you release www.Creativestores.co.uk (and all employees related to www.Creativestores.co.uk ) from all claims, liability, damages, losses, costs and expenses, including legal fees, known or unknown, arising from or in any way connected with such right, claim or action.

Nothing in this User Agreement shall limit or exclude www.Creativestores.co.uk liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees. Subject to the foregoing, www.Creativestores.co.uk will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this User Agreement. www.Creativestores.co.uk has no liability or for faults in or failures of their networks or equipment.

www.Creativestores.co.uk liability to you or any third party in any circumstance is limited to the greater of (a) the total fees you have paid to us in relation to the listing or other service offered giving rise to liability.

www.Creativestores.co.uk does not guarantee continuous, uninterrupted or secure access to our services, and operation of www.Creativestores.co.uk may be interfered with by numerous factors outside of our control. www.Creativestores.co.uk and the services www.Creativestores.co.uk are provided “as is” and as and when available, and to the extent permissible by law we exclude all implied warranties, condition or other terms, whether implied by statue or otherwise, including without limitation any terms as to skill and care or timeliness of performance.

Governing Laws and Legal Compliance

This USER AGREEMENT shall be governed by and construed in accordance with the law in England and Wales and subject to the exclusive jurisdiction of the English and Welsh Courts.

Note:

Your country (and/or that of any member you deal with) may have laws which apply to your transactions with other users regardless of what you agree with us (now) or with that member (later).

The laws of your country may be different from (English and Welsh) law including laws governing what can be legally offered, sold, exported, bought or imported. There may be additional legal requirements, relating to (e.g.) the requirement to hold a licence to buy or sell certain items, or to register a transfer in a central registry. You shall comply with all applicable domestic and international laws, statues, ordinances and regulations regarding your use of our service and your listing, purchase and solicitation of offers to purchase and sale of items. There is no practical way for www.Creativestores.co.uk to continually monitor the laws of every country, or each user transaction. Please do not assume that you are allowed to do what other users do, or that we are approving or validating any transaction, even if you have successfully made similar sales or purchases in the past.

Notices

Unless otherwise explicitly stated, notices to www.Creativestores.co.uk must be sent by mail or e-mail to www.Creativestores.co.uk , 40 Elms Road, Coton in the Elms, South Derbyshire DE12 8HD, United Kingdom or support@Creativestores.co.uk . Notices to you will be sent to the email address you provided during the registration process or by mail.

How you receive your payments.

All sales that occur in your store are made directly with the store owner by your designated preferred payment method. If customers are paying for your products via PayPal this is a fully secured payment method. You will need to have a PayPal account to sell your products and open a store on www.Creativestores.co.uk.

General

www.Creativestores.co.uk reserves the right to change these Terms and Conditions at any time. If the alterations constitute a material change to the Terms and Conditions, we will notify you by e-mail according to the preference expressed on your account. What constitutes a “material change” will be determined at our sole discretion and in good faith and using common sense and reasonable judgement.

You agree that this User Agreement and all incorporated agreements may be automatically assigned by www.Creativestores.co.uk , in our sole discretion, to a third party in the event of a merger or acquisition or any other event. You and www.Creativestores.co.uk are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this User Agreement. Headings are for reference purposed only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. The User Agreement sets for the entire understanding and agreement between us with respect to its subject matter. No oral explanation or oral information given by any party shall alter the interpretation of this User Agreement.

The Agreement will prevail over any conditions of sale imposed by a seller. Our privacy statement, fees policy and prohibited item policy, are incorporated in this User Agreement by reference. Each of the policies may be amended from time to time and you will be informed of any changes.
